IRS Initiatives to Look Out For in 2010
The IRS has four initiatives it is pursuing for 2010, as follows:
I. Worker Classification
The IRS has long been concerned that workers classified as independent contractors are actually employees under the law, resulting in underpayment of taxes. This underpayment is primarily from the employers side of the worker relationship. Further, workers who are misclassified may then decide to file unemployment, workers compensation or other claims that they could have filed as employees. Needless to say, this can result in very significant penalties, fines and defense costs. There are incentives to self-report and resolve these issues prior to the IRS (or other government agency) discovering the problem through audits or employee reports. IT IS CRITICAL TO REMEMBER that you cant just call a worker an independent contractor they have to meet the legal test, which involves a multi-factor balancing process.
II. Compensation of Officers of S Corporations
The IRS has also been concerned that officers in S corporations have been underreporting income; for instance, by taking money from the company in the form of dividends while paying themselves a below-market salary. The IRS will be auditing S corporations to look into these issues.
III. Employee Fringe Benefits
Travel, frequent flyer, expenses, use of employer property, education and other related fringe benefits are also going under the microscope at the IRS.
All of these issues focus on small and medium-sized businesses for the most part. In particular, owner-employees are going to be in the crosshairs. Now is the time to get your operations straight; if there are any inconsistencies or problems, they can be rectified much less expensively if you do it before the IRS, Unemployment or another government agency catches it.
